Terms & Conditions

Welcome to HeatXtreme INC. These Terms and Conditions ("Terms") govern your access to and use of our website, services, and SMS/text messaging program. By using our website, submitting a form, opting in to receive text messages, or purchasing our services, you agree to be bound by these Terms.

Please read these Terms carefully before using our services. If you do not agree with any part of these Terms, you must not use our website or services.

1. General Terms

HeatXtreme INC provides 1:1 fitness coaching services, including personalized training programs, nutrition planning, accountability coaching, and related health and wellness guidance. Our services are delivered through a combination of online communication, virtual check-ins, and digital resources.

By engaging with our services, you acknowledge that fitness coaching is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before starting any new exercise or nutrition program, especially if you have pre-existing medical conditions.

2. Payments & Refund Policy

All sales are final. All purchases of HeatXtreme INC coaching services are non-refundable.

By completing your purchase, you acknowledge and agree that:

• All payments for coaching services are non-refundable, regardless of whether you complete the program, utilize all sessions, or achieve your desired results.
• Due to the personalized nature of our coaching services — including custom training programs, nutrition plans, and one-on-one strategy sessions — significant resources are allocated upon enrollment. For this reason, refunds, credits, or exchanges will not be issued under any circumstances once payment has been processed.
• If you purchase a coaching package using a payment plan (installment payments), you remain responsible for all remaining payments regardless of whether you continue to participate in the program. Failure to complete scheduled payments may result in collection action.
• If you purchase using a buy now, pay later service (such as Affirm, Afterpay, or Klarna), your obligation to complete all payments is governed by the terms of that third-party provider. HeatXtreme INC receives the full payment at the time of purchase and is not responsible for disputes between you and the financing provider.
• Chargebacks or payment disputes filed in bad faith — after services have been delivered or made available — may result in the suspension of your coaching access and may be contested with supporting documentation.

We stand behind the quality of our coaching and are committed to delivering the program as described. If you experience any issues with your service, please contact us at [email protected] so we can work to resolve your concern.

2.1 Reserved Coaching Spot & Deferred Start

By completing your enrollment, you confirm that you reviewed and agreed to our no-refund policy prior to finalizing your purchase, including any purchase made through a buy now, pay later provider such as Affirm. In accordance with that agreement, any payment that has already been processed will be honored in full and remains non-refundable.

This does not mean your investment is lost. If circumstances — whether personal, medical, or otherwise — prevent you from beginning or continuing your program at the originally scheduled time, your coaching spot will remain reserved on your behalf. Your program and all associated resources will be held ready, and you may resume your coaching exactly where you left off whenever you are in a position to start. We encourage you to prioritize your wellbeing, and we will be ready to continue your program when you are.

3. Eligibility & Age Restriction

You must be at least 18 years of age to use our website, purchase our services, or opt in to our SMS messaging program.

By accessing our website, submitting any forms, or opting in to receive text messages, you represent and warrant that you are at least 18 years old. If we learn that we have collected personal information from a person under the age of 18, we will take steps to delete that information as soon as possible.

If you are under 18, please do not submit any personal information through our website or opt in to any of our communications.

6. Message & Data Rates

If you have questions about your text or data plan, please contact your mobile carrier for pricing and plan details.

15. Results Guarantee

HeatXtreme INC stands behind the effectiveness of its coaching program. Subject to the strict eligibility requirements set forth in this Section, HeatXtreme INC offers the following guarantee:

15.1 Eligibility Requirements

To be eligible to invoke this guarantee, a client must satisfy all of the following conditions without exception. Failure to meet any single condition — regardless of overall effort or partial compliance — results in automatic forfeiture of guarantee eligibility:

• Check-Ins: Every scheduled weekly check-in form or call must be completed and submitted on time, within the deadline communicated by HeatXtreme INC. No missed, late, or incomplete check-ins are permitted.
• Training Sessions: Every training session prescribed by HeatXtreme INC must be completed within the calendar week in which it is assigned. No skipped sessions, substitutions, or self-modified workouts are permitted. Completion must be logged in the designated tracking platform.
• Caloric Compliance: Daily caloric intake must remain within ±2.5% of the daily caloric target prescribed by HeatXtreme INC for every single day of your program term (90 days for the 3-month program, or 180 days for the 6-month program). Compliance must be demonstrated through a full daily log maintained in a HeatXtreme INC-approved nutrition tracking application (e.g., MyFitnessPal), with records available for review upon request. A single day outside the ±2.5% window — whether above or below — constitutes non-compliance and voids guarantee eligibility for the entire program period.
• Macro Adherence: In addition to total caloric targets, daily macronutrient targets (protein, carbohydrates, and fat) as prescribed must be tracked and logged each day. Failure to log macros on any single day voids eligibility.
• Communication Responsiveness: All communications from HeatXtreme INC — including but not limited to coaching messages, adjustment notifications, and check-in reminders — must be responded to within 24 hours. Unresponsiveness for more than 24 hours on any occasion voids eligibility.
• Progress Documentation: Required progress photos must be submitted on the scheduled dates and times specified by HeatXtreme INC. Missed or late submissions void eligibility.
• No Undisclosed Medical Changes: Any change in health status, medication, or medical condition that may affect the program must be disclosed to HeatXtreme INC immediately. Failure to disclose such changes voids eligibility.
• Agreed Goal: The specific result being claimed against the guarantee must be the exact result documented in writing by both the client and HeatXtreme INC at the time of enrollment. Results not agreed upon in writing prior to the program start are not covered.

15.2 Guarantee Scope and Limitations

• This guarantee applies solely to continued coaching services at no additional cost. It does not constitute a right to a monetary refund, credit, or any other form of compensation.
• Extended coaching provided under this guarantee is subject to HeatXtreme INC coach availability and reasonable scheduling constraints.
• The guarantee applies only to the client's initial program term (3-month or 6-month) and cannot be invoked for renewal, extended, or subsequent program terms.
• HeatXtreme INC reserves the right to request full documentation of compliance with all eligibility requirements before activating extended coaching. The burden of proof lies solely with the client.
• Guarantee claims must be submitted in writing to [email protected] within seven (7) calendar days of your program term end date (the 90th day for the 3-month program, or the 180th day for the 6-month program). Claims submitted after this window will not be honored.
• This guarantee is non-transferable and applies exclusively to the enrolled client.

15.3 Acknowledgment

By enrolling in HeatXtreme INC coaching services, you acknowledge that you have read, understood, and agree to the eligibility requirements of this guarantee. You further acknowledge that the ±2.5% daily caloric compliance requirement is strict by design and that any deviation — however minor — on any single day of your program term (90 days for the 3-month program, or 180 days for the 6-month program) renders you ineligible to invoke this guarantee.
